Milwaukee's Paid Sick Leave Ordinance Declared "Invalidly Enacted and Unconstitutional"

Milwaukee County Circuit Court Judge Thomas Cooper released his ruling on Friday, June 12, 2009 on the City of Milwaukee's paid sick leave ordinance. He declared the ordinance "invalidly enacted and unconstitutional." 

As you may recall, nearly 70 percent of Milwaukee voters supported this ordinance in a referendum on November 4th, 2008, when they went to vote in the presidential election. 

The Wisconsin Restaurant Association helped to organize a coalition of small business groups to fight this ordinance, and supported the Milwaukee Metropolitan Association Commerce's lawsuit against the City.  

Many WRA members contributed their money and time to the fight against this ordinance. The National Restaurant Association also contributed generously to fight the ordinance, which would surely have raised costs for employers and driven jobs out of Milwaukee.

Unfortunately, this decision has been appealed to Wisconsin's 4th District Court of Appeals. Arguments on the case were heard on January 20, 2010.
